MASAF Appellate Disciplinary Commission has denied Mauro Baroncini the suspension of the enforceability of the decisions taken on 8/1/2025 by the Jury at Milan racecourse.
On the occasion of the Pantera del Pino prize, the professional was in fact given a one-year disqualification (until 9/1/2026) and a fine of 2,000 euro for ‘carrying out prohibited practices on the day of the race on the horse Filly Mail with the administration of substance by means of a rhino-oesophageal probe’.
In particular, the device states that ‘the contested infringement for violation of anti-doping regulations, appears to be a special rule that derogates from the general one; therefore finding, without prejudice to any other deepening in the merits of the judgement; correspondence about the conduct ascertained, as formalised in the contested measure, circumstances that do not depose the existence of the ’fumis boni iuris.’
In addition, the Commission ‘considered the non-existence of the periculum in mora, in view of the fact that the proceedings, instead of what has been deduced by the appellant, will be dealt with on the merits, at the hearing already fixed on 14/2/2025’.
Hearing on the matter, lawyer Giovanni Sibilio, Mr. Baroncini’s defence counsel, stated that ‘since the hearing has already been set for 14 February, on that date we count on demonstrating the complete extraneousness to the facts of our client Mauro Baroncini.
